Highest court of country has urged the parliament to consider framing comprehensive legislation to protect the interests of women and children born a live-in relationships as according to court that relationship is "neither a crime nor a sin though socially unacceptable in this country" and said that all live-in relationships — and especially polygamous relationships — would not come under the definition of a relationship in the nature of a marriage, pointed out that the increasing number of such relationships called for attention from parliament. And such relationship, may endure for a long time, and can result in a pattern of dependency and vulnerability, and increasing number of such relationships calls for adequate and effective protection, especially to the woman and children born out of that live-in-relationship. law cannot promote pre-marital sex, though, at times, such relationships are intensely personal and people may express their opinion, for and against. these relationships fell outside the purview of the Domestic Violence Act, and women and children were deprived of benefits like alimony and shelter both because of the legal vacuum and the deficiencies in the law.
Therefore the court said that Parliament should ponder over bringing in a proper legislation or make amendments to the Act so that women and the children born out of such kinds of relationships be protected, though those types of relationship might not be a relationship in the nature of a marriage.
According to court the guiding factors would be the duration of the relationship, a shared household, pooling of resources and financial arrangements, domestic arrangements, and a sexual relationship — not just for pleasure, but an emotional and intimate relationship, and for procreation.
On one side the courts are worried more for protection of women but on the other side hijacked by some individuals khap panchayats and immorally motivated individual sentiment in a impractical as well as unethical and self destructive activity. There are wide divide between endeavors of legislation , efforts of courts in protection those endeavors and degrading societal tendency hijacked by some individual ambitions motivated by immoral and violent purpose against women.
Few people are controlling, misusing and destroying the pious age old Khap Panchayts institution and earning it defame just for their immorally motivated attitude and immorally motivated individual sentiment.
It is not matter of failure on the part of Administration Law or on the part of Khap Panchayts but it is degradation of moral value and failure of system living like family otherwise we could not have heard that a young women being decreed to witness and experience cruelty and inhuman treatment of being raped by several men and branding it enjoyment and having fun with her. The fault is not in the age old Khap Panchayat system rather individual moral value have vanished otherwise the principal on which our Khap Panchayat are established very pious.
That individual woman not died but our moral values have sustained massive injuries and we are left behind to live in suffocating dishonorable life.
