1. The Full Bench of the
CIC by its order dated 3-6-2013, upheld the applicability of RTI Act
to six major Political party and directed them to appoint CPIOs and
First Appellate Authorities within six week of the order but these parties
neither appeal against the said order nor have complied with the same.
2. One of the complainant
filed a Non-compliance complaint on 29-8-2013 with the CIC but neither the
complaint was registered nor any action in the matter was taken despite two
more subsequent complaints. Thereafter, the main files and records of this case
have gone missing in the CIC.
3. After Times of India
exposed such inaction of CIC in its Delhi edition dated 29-1-2014, now the
CIC on this Friday has issued notices to Political Parties but
without even registering the Non-compliance complaint, which is contrary and in
defiance to the decision taken in the Full Court Meeting held on 18-8-2009.
4. The very fact that
first the Non-compliance complaint was not registered for nearly six months and
thereafter, the main files and case records have gone missing points to the
sinister attempt to render the Full Bench decision of CIC infructuous.
5. There are numerous
complaints regarding the missing records and petitions in the CIC. Despite
confirmation of Postal Department, CIC is taking stand that documents have not
been received. In one case, the appellant filed complaint with Delhi Police and
after inquiry by the ACP of Safdarjung Enclave, New Delhi, CIC admitted having
received the documents, such hoax claims of missing records in CIC makes the
appellant and complainant vulnerable against corruption and exploitation.
6. We have moved a
representation to Ms. Sushma Singh, Hon’ble Chief Information Commissioner for
filing police complaint and ordering initiation of disciplinary action in the
matter. Copy of the said representation is attached.
